In the event of insolvency or over-indebtedness, the representatives of a partnership are obliged to file for insolvency.
Personal insolvency
As a private individual (consumer within the meaning of Section 304 of the German Insolvency Code), you must attempt to reach an out-of-court settlement before filing for insolvency. A person or body recognized for debt counselling must be involved in this process.
Insolvency proceedings are used to settle debts, restructure a company or liquidate a company and distribute the remaining assets to the creditors.
