Home care costs (uncovered) - Assistance for care in facilities in accordance with Chapter 7 SGB XII
Residential care is associated with high costs. People in need of care are rarely able to cover these costs from their own income and assets. The uncovered costs can be covered by social welfare on application.
According to the German Civil Code (BGB), children are liable to pay maintenance to their parents. The same applies to spouses, even after a divorce.
Up to the amount of the social assistance expenses, this maintenance claim against the children or against the separated or divorced spouse is transferred to the social assistance provider. If there is an ability to pay, the claim is made in accordance with the provisions of the German Civil Code (BGB) or the established case law.
The Kleve district administration decides whether assistance for care in institutions (residential care) is granted. However, the application can be submitted via the local social welfare office.
Required documents
- Identity card or passport
- Severely disabled person's pass, if available
- Bank statements for the last 3 months of all existing accounts
- Proof of health insurance (chip card)
- current pension certificate
- If applicable, further proof of income (additional pension, renting, etc.)
- Notification of the level of care
- Property documents, if available, e.g. savings book, certificate of deposit, extract from the land register for house and apartment ownership, vehicle registration document
- Care certificate or power of attorney
- Home contract
- Name, address and dates of birth of all dependants (usually children)
The required documents will be copied after submission.
In individual cases, further evidence may be required for processing.

Residential care allowance
An application for residential care allowance can be included together with the application for the assumption of home care costs. Please bring the application with you to the appointment.
