Purpose of data processing

The purpose of data processing is to process your citizens' application in accordance with Section 24 of the Municipal Code for the State of North Rhine-Westphalia (GO NRW).

This includes in particular

  • the registration of the person or group making the application,
  • examining the admissibility requirements of the citizens' petition,
  • forwarding the application to the responsible political bodies,
  • the preparation of discussions in the Council or in the specialist committees,
  • documentation in the context of municipal committee work,
  • contact in the event of queries.

Your personal data will only be used to process your citizen application (purpose limitation).

Main legal basis

The processing of your personal data takes place on the basis of:

  • Art. 6 para. 1 lit. e) GDPR in conjunction with § 3 DSG NRW (performance of public duties),
  • § Section 24 of the NRW Municipal Code (right to submit a citizens' petition),
  • §§ 48 ff. GO NRW (meeting service, council work),
  • municipal rules of procedure of the Council.

Recipients and categories of recipients of the data

Your data will only be passed on within the framework of legal requirements.
Possible recipients are:

  • internal departments of the pilgrimage town of Kevelaer involved in the preparation of the political consultation,
  • Members of the Council and its committees, insofar as this is necessary for the consultation and decision on the citizens' application,
  • the public, insofar as this is required according to the public meeting documents.
    (Note: personal data is reduced in public documents as far as possible; sensitive data is not published).

Data is not transferred to third countries.

Duration of storage and retention periods

Your personal data will be stored for the duration of processing and political consultation.
The statutory retention periods for documents relating to municipal committee work then apply.

As a rule, the retention period is:

  • 10 years for council and committee documents,
  • subsequent transfer to the municipal archive, if archival value.

After expiry of the statutory periods, documents not worthy of archiving are deleted.

Rights of the data subject

Your rights to information, correction, deletion, restriction of processing, data transfer and objection regarding the personal data collected are expressly pointed out at this point. The legal basis for this is Articles 15 to 21 of the EU General Data Protection Regulation and Sections 49 and 50 of the NRW State Data Protection Act.
