Purpose of data processing
The purpose of the processing is to check and decide on the issue of a certificate of eligibility for housing (WBS) in accordance with the requirements of the housing subsidy law in NRW.
This includes in particular
- the recording of personal data of all applicants and persons living in the household,
- the examination of income and housing needs,
- the determination of the relevant apartment size and income limits,
- the preparation and issue of the certificate of eligibility for housing or a notice of refusal.
Your data will only be used to process your WBS application (earmarking).
Main legal basis
Your personal data is processed on the following legal basis:
Art. 6 para. 1 c) GDPR (fulfillment of a legal obligation) in conjunction with the provisions of the NRW Housing Promotion Act (WFNG NRW), in particular §§ 17 ff., Ordinance on the Implementation of the NRW Housing Promotion Act (DVO-WFNG NRW), §§ 1, 3 and 8 WoBindG
Recipients and categories of recipients of the data
Your personal data will only be processed within the scope of data protection law. Recipients may be in particular
- internal departments of the pilgrimage town of Kevelaer within the scope of processing,
- Landlords or housing companies, if necessary to check eligibility for housing,
- Supervisory and auditing authorities, insofar as statutory auditing obligations exist.
Your personal data will not be transferred to third countries.
Duration of storage and retention periods
Your data will be stored for the duration of the entire application and approval process.
The statutory municipal retention periods then apply. As a rule, the retention period is as follows:
- 5 years after the end of the calendar year of the decision (in accordance with municipal retention guidelines).
After this period has expired, your personal data will be deleted unless there are legal grounds for longer storage.
Rights of the data subject
Your rights to information, correction, deletion, restriction of processing, data transfer and objection regarding the personal data collected are expressly pointed out at this point. The legal basis for this is Articles 15 to 21 of the EU General Data Protection Regulation and Sections 49 and 50 of the NRW State Data Protection Act.
