Purpose of data processing
Your personal data is processed in order to receive, review and respond to your request for access to files in accordance with the North Rhine-Westphalia Freedom of Information Act (IFG NRW). Your personal data to be processed in this context is earmarked, i.e. it will only be used for the purpose for which it was collected.
Main legal basis
Your personal data is processed on the basis of Art. 6 para. 1 lit. c GDPR (fulfillment of a legal obligation) in conjunction with § 4 IFG NRW.
Recipients and categories of recipients of the data
Your data will only be processed by Department 1.1 in accordance with data protection legislation. Personal data will not be transferred to third countries.
Processed in particular:
- Contact details (name, address, e-mail, telephone number)
- Details of your request (file/process reference, description of the information request)
- Communication data (correspondence with the administration)
Within the city administration, only the departments responsible for processing your application will have access to your data. If necessary for processing, your data may be transferred to other public bodies or authorities.
Duration of storage and retention periods
The personal data will be stored for the duration of the processing of your application. At the end of this period, the data will continue to be stored in accordance with the retention periods under state law in conjunction with municipal and budgetary regulations (e.g. retention periods in accordance with Section 13 (2) of the Ordinance on the Budgeting of Municipalities - GemHVO NRW). As a rule, the retention period is 5 to 10 years after the purpose of processing no longer applies. After this period, the data will be deleted, provided that there are no further statutory retention obligations.
Rights of the data subject
Your rights to information, correction, deletion, restriction of processing, data transfer and objection regarding the personal data collected are expressly pointed out at this point. The legal basis for this is Articles 15 to 21 of the EU General Data Protection Regulation and Sections 49 and 50 of the NRW State Data Protection Act.
