Land use plan amendment procedure
In accordance with the provisions of the German Building Code, a two-stage participation procedure is required for the preparation or amendment of the land use plan. Accordingly, a preliminary draft is first prepared to inform the public as early as possible about the general objectives and purposes of the planning. This is the first opportunity to make suggestions and raise concerns about the planning.
In a second step, a draft plan is drawn up, which is again put on public display and on which those affected can again comment. The planning is initiated by resolutions of the Committee for Urban Development and Economic Development of the Council of the pilgrimage town of Kevelaer and guided through the various procedural steps. Ultimately, the council adopts a resolution on the plan amendment. In the course of the procedure, the planning must be coordinated with the district government and approved by it following the council's decision. Once the approval has been announced, the plan amendment becomes legally binding.
